What every homeowner should know before building – Keeping your project legal and yourself protected
Laneway suites have quickly become one of the most popular ways to add value and flexibility to properties across Toronto. What many homeowners don’t realize, however, is that these projects are legally considered new homes in Ontario.
That classification comes with clear requirements. Any laneway or garden suite must be built by a builder licensed with the Home Construction Regulatory Authority (HCRA) and registered with the Tarion Warranty Corporation. This applies whether you plan to rent the space out, use it for family, or live in it yourself. Under Tarion, it is still considered a contract home.
What Tarion means for you
Tarion provides structured protection after your home is built, covering workmanship, major systems, and structural integrity over multiple years. More importantly, it ensures there is a clear, regulated process to address any issues that arise—giving homeowners confidence that their investment is protected.
Tarion provides structured warranty protection for new homes in Ontario, including:
- 1-Year Warranty: Covers defects in workmanship and materials
- 2-Year Warranty: Covers major systems (plumbing, electrical, HVAC) and building envelope issues
- 7-Year Warranty: Covers major structural defects
This all ensures that builders are accountable not just during construction, but long after the project is complete.
Why this matters
When a project is not compliant, the consequences can become highly disruptive, expensive, and in some cases, project-altering.
Regulators have the authority to issue stop-work orders, halting construction entirely. That means your timeline is no longer in your control. Delays begin to stack up, trades get rescheduled, and costs escalate quickly. If enforcement action is taken, there may also be fines or requirements to bring the project back into compliance—costs that inevitably find their way back to the homeowner.
At the same time, you’re exposed on the back end. Without Tarion, there is no structured warranty protection. If something fails—whether it’s workmanship, building systems, or structural elements—you’re relying entirely on the goodwill of a builder who has already chosen to operate outside of the rules.
Financing can also become an issue. Lenders are increasingly aware of these requirements, and non-compliant projects can raise red flags, delay funding, or in some cases jeopardize it altogether.
